No win, no fee Deposit Protection Claims
If you are a tenant living in a private property, then the chances are that you paid a deposit to your Landlord.
Since 2007, under the Housing Act 2004, Landlords have been obliged to register any deposit received for privately rented properties with the Deposit Protection Service (DPS), Tenancy Deposit Scheme (TDS) or MyDeposits.
MyDeposits - https://www.mydeposits.co.uk/
If you paid a deposit to your landlord, then a record of it must be held by one of the above agencies. If your Landlord did not do so then you could claim your deposit back, plus up to 3 times the value of your deposit in compensation for each tenancy period, going back up to 6 years.
My Landlord did not return my deposit
When you left the property, or if you are in the process of doing so, if your Landlord is being difficult about releasing your deposit back to you, or is making it difficult to do so, then it is worth checking whether the deposit was registered with one of the above 3 agencies at all.
Firstly, ask the Landlord specifically which of the agencies they registered the deposit with and to pass to you the deposit protection reference number.
Next, contact the 3 different agencies directly to determine whether your deposit for your occupation of the premises is recorded with one of them.
Your Tenancy Deposit Claim Could Be Worth Over £10,000
You are entitled to claim compensation for every time your landlord has failed to protect your deposit.
If you signed a new tenancy at the same property and your deposit was still not protected, this would be considered a new breach of the rules.
Did you stay in the property after your 6-12 month initial tenancy term? That will count as a new tenancy, even if the Landlord did not give you a fresh tenancy agreement.
Has this ever happened to you at a previous property? Your right to claim lasts for up to 6 years, so even after you’ve left the property.
Has your landlord deducted any money from your deposit? If it wasn’t protected, they are not entitled to do so, you can claim a full refund of your deposit.
